That is a pattern you might expect. But I doubt DECN would settle its lawsuit against J&J by agreeing to "sell" its technology to Platinum in return for a settlement slug of cash. In fact, in today's enterprise value summing world, that might be seen as a "sell-out" by those who follow such things. DECN has argued that J&J are crooks and law-breakers using their monopoly powers to gain further monopoly powers, by stepping on lesser competitors like DECN.
Now, I do believe that the settlement amount would be greater if it were to include a technology transfer from DECN to NewCo, but KB went to IU, and the B-school at IU has always taught Proctor & Gamble's enterprise value analysis. Selling technology as a part of a lawsuit termination might be seen by KB as anti-American, which I know would pit him against the many, many flips and traders in DECN stock.
In a slightly warped sort of way, I believe nonseq's statement that the flips and traders will become a menace -- as if they already aren't.
